Public seminar on compensation measures.

The EU Water framework directive (WFD) has had profound consequences for both fresh and coastal water management. Not least since 2015, when the EU Court of Justice in the so-called Weser case made it clear that member states must refuse authorisation for any project that will result in deterioration of the status of a water body or even jeopardise the attainment of good surface water status, unless the project is covered by a derogation.

This has attracted a lot of attention to the definition of deterioration and the preconditions for derogations but has also prompted many actors to look for ways to compensate for nutritional input in water bodies by means of activities that extract nutrients, thereby enabling activities that may otherwise not be permissible.

The workshop is dedicated to identifying and discussing legal and policy differences between Denmark, Finland, Aaland and Sweden with regard to the interpretation of the directive/the Weser case and the implications for the taking of compensation measures (e.g. mussel farming) as a way to create "space" for activities that entail nutrient leakage.

What differences exist? How can they be explained considering that the same EU legal framework applies? What may we learn from each other in terms of how best to contribute to the development of sustainable marine activities and healthy seas? Special attention will be given to the role of different forms of aquaculture in this respect.

In addition to presentations on the situation in the respective Nordic countries (and autonomous region), the seminar will feature a panel discussion among legal and science scholars and representatives of the aquaculture industry. There will also be room for questions and general discussion.
